The bail plea of RJD leader Lalu Prasad Yadav in the Dumka treasury case has been rejected by the Jharkhand High Court. In this case, Lalu Prasad has been sentenced by the CBI court to 7 to 7 years jail in two different sections. Lalu Prasad had requested the High Court to grant bail on the basis of deduction of half the sentence.
After hearing for about four hours, the court of Justice Aparesh Kumar Singh admitted that Lalu Prasad’s claim is not correct and that his half sentence is about 60 days short of completion. In such a situation, they cannot be granted bail. After the bail is rejected, Lalu Prasad will now have to file a bail petition again in the High Court after 60 days.
Lalu Yadav had sought bail on the basis of completing half the period of punishment in the case of illegal withdrawal from the Dumka treasury of the fodder scam. The trial court sentenced him to seven years in the case. During the last hearing, Lalu Yadav had claimed to be in jail for more than 42 months.
Lalu’s claim was rejected by the CBI. Lalu has already got bail in other cases related to the fodder scam. He is currently in judicial custody only because of the punishment in the case of illegal withdrawal from Dumka treasury. Lalu is being treated in AIIMS in judicial custody.
In the High Court, Lalu’s bail plea was listed for hearing at number 16 and the case for jail manual violations at number 14. Lalu has been granted bail in cases other than the illegal evacuation of the Dumka treasury. Lalu, who was convicted in the Dumka treasury case, had sought bail, claiming to have completed half his sentence. Lalu’s Bell Petition was filed by Kapil Sibal, a senior advocate of the Supreme Court. Sibal demanded Bell, citing half of the seven-year sentence given to Lalu by the trial court.
