Hate speech Case: Amit Veer Singh, an MP/MLA sessions court judge, overturned the three-year imprisonment that had previously been given to the top Samajwadi Party (SP) leader in the Azam Khan hate speech case. Anil Kumar Chauhan, the complainant and a government employee, provided a statement that served as the basis for the judge’s decision.
In its decision on Wednesday, the court cited Chauhan’s declaration that “I had registered a complaint under the pressure of the district election officer.”
In connection with a hate statement he made back in 2019, Anil Kumar Chauhan had reported Azam Khan.
Chauhan said, “After reviewing the CD containing the speech, I felt the speech delivered by the Member of Parliament would create animosity among the people and incite Hindu-Muslim conflict. He also used derogatory language against leaders and officials, violating the code of conduct. The written statement I provided was under pressure from the District Election Officer. After reviewing the CD, I wrote the things in the statement based on the speech.”
Vinod Sharma Azam Khan’s lawyer said, “This case was registered at Milak police station and the complainant in this case was Anil Kumar Chauhan. It was related to a hate speech matter, for which we were convicted in the lower court, but now the conviction has been overturned after our appeal.”
Sharma responded, “He was the one who filed the FIR in the hate speech case,” in response to a question about who Anil Kumar Chauhan was in this situation.
When asked further about the details of his court testimony and the ruling, Azam Khan’s attorney responded, “He explained his side in the court and later we cross-examined him. Many things came up during the cross-examination. It came to the fore that Chauhan lodged the FIR under pressure from the District Election Officer.”
“We told the court that Azam Khan had been falsely implicated and the appellate court accepted our argument and acquitted him,” the lawyer said.
In a 2019 case involving hate speech, Samajwadi Party politician Azam Khan was declared innocent on Wednesday. He was found guilty in the same case last October for allegedly speaking derogatorily about Yogi Adityanath, the chief minister of Uttar Pradesh, during the 2019 Lok Sabha elections.
The Rampur court sentenced him to three years in prison, which resulted in his exclusion from the UP Assembly.
