Consumer Forum Orders Jaguar to Pay Rs 42 Lakh Compensation to a Car Owner; Here’s Why

Jaguar Land Rover: Luxury car manufacturer, Jaguar Land Rover India has recently got an order by a consumer forum to pay Rs. 42 lakh compensation or fit a new engine along with paying Rs. 55000 in damages to a businessman in Chennai. Check out more details below.

S. Ramesh, purchased a luxury car XF 3.0 L from VST & Sons showroom in Ethiraj Salai in 2016 and repeatedly experienced engine failure in the vehicle even when was under the warranty period. ‘

In March 2018, during a personal tour in Bengaluru, car owner’s engine was seized in the mid way with a heavy sound indicating a severe damage to the engine. This engine failure comes when the car was only driven 22400 km and was in the warranty period. Somehow, the car owner managed to take his car to a showroom located in Bengaluru. Because the vehicle was covered under a three-year warranty period, he got his car’s engine replaced by the service centre free of cost.

Next year, he encountered the same engine issue in his car, but this while, the showroom owner denied to repair the car free of cost as the vehicle was no more in a warranty period. Service centre kept the vehicle for more than a year and didn’t returned. This is when the Pothys filed an official complaint against them in the Chennai Consumer Disputes Redressal Commission for selling an “Inherently defective” and “faulty” car.

What Showroom Owner Said

Responding to the filed complaint, VST and sons, said the car owner used the car excessive commercial use and didn’t serviced it on time which eventually resulted in unusual damage in the vehicle. For not returning the car to owner for almost an year, showroom owner stated the reason of COVID-19 lockdown.

Jaguar Land Rover India Defended

Luxury Automaker, Jaguar Land Rover India defended itself by stating that the car owner has not presented appropriate evidence to prove his claim right that we manufactured an “Inherently defective” car. They added that the showroom offered the car owner to get his car repaired at 50 percent charge of the invoice value (nearly Rs. 42 lakh). The car owner demanded the replacement of his car unjustly.

Final Verdict

However the consumer forum rejected all their points and ruled in favor of Pothys by ordering either a compensation of Rs. 42 lakh to the consumer or to fit a new engine with Rs, 55000 for damages.
