Two months after his retirement as a Supreme Court judge, the central government has appointed Justice Hemant Gupta as the chairman of the New Delhi International Arbitration Centre. The Appointments Committee of the Cabinet had approved the appointment of Justice Gupta in a notification issued on 19 December. He retired on October 16 after a four-year tenure in the Supreme Court.
During his tenure as an SC judge, Justice Hemant Gupta delivered several important judgments, including the judgment in the Karnataka hijab ban case. In the hijab case, Justice Hemant Gupta, just three days before his retirement, dismissed appeals challenging the March 15 judgment of the Karnataka High Court, which had refused to lift the ban. Justice Sudhanshu Dhulia disagreed with Justice Hemant Gupta.
Challenge the decision of the Karnataka High Court
Justice Hemant Gupta was also part of another division bench’s judgment of the two-judge bench delivered in August this year. In this, the decision of the Karnataka High Court allowing the use of Idgah grounds in Chamarajpet, Bengaluru for Ganesh Chaturthi celebrations was challenged. The case was heard on the same day by a three-judge bench, which stayed the High Court’s decision.
The Center appointed Ganesh Chandru, partner, Dua Associates, and advocate Ananth Vijay Palli as its part-time members. Palli is the son of former Punjab and Haryana High Court judge PK Palli and is married to Delhi High Court judge Rekha Palli. His brother, Justice Arun Palli, is currently a judge of the Punjab and Haryana High Court.
Bill introduced to set up International Arbitration Center
Last week, Union Law and Justice Minister Kiren Rijiju introduced a bill in the Upper House to rename the New Delhi International Arbitration Center as India International Arbitration Center and passed it by voice vote. Established in 2019, the NDIAC has been declared an institution of national importance and is mandated to be a seven-member body. Which is presided over by a former judge of the Supreme Court or a High Court or an eminent person.
