Congress leader Rahul Gandhi has approached the Gujarat High Court after the Surat Sessions Court rejected his plea to stay his conviction. The Surat sessions court on Thursday dismissed Congress leader Rahul Gandhi’s appeal to stay the two-year sentence awarded to him by a magistrate court in a criminal defamation case filed against him by BJP MLA Purnesh Modi.
The court of Additional Sessions Judge RP Mogera had said that the appellant needs to establish and satisfy the court on the fact that the case is a rare and exceptional case for grant of stay against conviction.
It also stated that “non-grant of stay against conviction should have irreversible consequences for injustice and irreparable harm and that there should be no criminal propensity except for dubious conviction”.
