Rahul Gandhi Defamation Case: Days after the Supreme Court stayed Rahul Gandhi’s conviction in a 2019 defamation lawsuit due to his comments on the “Modi surname,” Gandhi, the leader of the Congress, had his membership in parliament restored. Rahul Gandhi‘s disqualification from serving in the Lok Sabha had been lifted, according to a statement from the secretariat.
Rahul Gandhi’s March Setback in Lok Sabha Eligibility
On March 23, Rahul Gandhi lost his eligibility to serve in the Lok Sabha after a Gujarat court found him guilty of defamation for his comments on the “Modi surname” and sentenced him to two years in prison. A legislator is immediately disqualified for any sentence of more than two years. The decision to reinstate Rahul Gandhi’s parliamentary membership was hailed as a “welcome step” by Congress President Mallikarjun Kharge.
Kharge Criticizes BJP for Focusing on Opposition Rather Than Governance
Hitting out at the government, Kharge said, “Whatever time is left of their tenure, BJP and Modi government should utilise that by concentrating on actual governance rather than denigrating democracy by targeting opposition leaders.” As soon as the news arrived, there were celebrations at the party’s headquarters and in front of Congress veteran Sonia Gandhi’s home. On August 4, the Supreme Court issued a stay of execution for Rahul Gandhi’s conviction in a criminal defamation action stemming from his ‘Modi surname’ remarks from 2019. The court added observed that the trial judge from a Surat court had not given good cause for imposing the two-year maximum penalty. Prior to his disqualification in March of this year following his conviction, Rahul Gandhi was an MP representing the Wayanad Lok Sabha constituency in Kerala as of 2019. The Gujarat High Court rejected the Congress leader’s petition last month to put his conviction on hold while the session court heard his appeal to have the sentence completely overturned, so he went to the Supreme Court.
