The Supreme Court, on Friday, deferred the hearing of Trinamool Congress leader Mahua Moitra‘s plea challenging her expulsion as a Lok Sabha member over alleged misconduct in the cash-for-query case. The court has set the next hearing for January 3, 2024. Moitra, who represented the Krishnanagar Lok Sabha seat in West Bengal, faced expulsion on December 8, following accusations of her “direct involvement” in “unethical” conduct related to the cash-for-query charges.

Allegations of Substantial Illegality and Arbitrariness

In her defense, Mahua Moitra has raised concerns about “substantial illegality” and “arbitrariness” by the Lok Sabha ethics committee, which recommended the expulsion. The controversy revolves around the ethics committee’s decision and its implications on Moitra’s parliamentary standing. Her legal counsel, senior advocate Abhishek Manu Singhvi, argued that the committee’s actions were flawed and required urgent judicial review.

Supreme Court’s Winter Break Pause

The hearing before the Supreme Court, led by Justice Sanjiv Khanna, took place on the last working day before the court’s winter break. Moitra’s legal team had previously sought an expedited hearing, emphasizing the urgency of the matter. The court’s decision to adjourn the case raises anticipation for the legal battle that will resume in the new year, with potential ramifications for Mahua Moitra’s political career.
