While hearing petitions challenging the ban on wearing hijab in government colleges of Karnataka, the Supreme Court raised several questions from lawyers. Hearing the matter on Monday, the Supreme Court said that a person has the right to practice religion, but the question is whether it can be taken to educational institutions with dress code?
Hearing petitions challenging the Karnataka High Court’s decision, the Supreme Court asked whether a student can wear a hijab in a school where a dress code has been prescribed. So the Supreme Court said that a dress code applies to golf courses and restaurants as well. Even the courtroom has a dress code.
Hearing the matter, a bench of Justices Hemant Gupta and Sudhashu Dhulia said that wearing hijab can be a religious practice but the question is whether hijab can be taken in such schools where there is a dress code? The court said that you can have a religious right … Can you take that right inside an educational institution where a uniform is prescribed.
Supreme Court on Uniform
Justice Gupta asked senior advocate Sanjay Hegde, representing one of the petitioners, whether the absence of a dress code would enable students to wear anything in class. On the argument that hijab ban can deprive women of education, the bench said that the state is not violating any rights. The state is saying that come in the uniform which has been prescribed for the students.
