The Center has told the Delhi High Court that Twitter Inc. It has failed to comply with the new IT regulations. The law of the land and its compliance is mandatory.
In its affidavit, the Center told the Delhi High Court, “Despite giving 3 months time to all SSMIs (Important Social Media Intermediaries) to comply with IT Rules 2021 and the deadline expires on May 26, Twitter Inc. has failed to comply.”
The affidavit said as of July 1, Twitter has not appointed a chief compliance officer, resident grievance officer, nodal contact person (even on an interim basis), and is not showing physical contact address on its website as mandated under the rules.
The document also said IT rules are “law of the land” which the San Francisco-headquartered company has to comply with. “Any non-compliance amounts to a breach of the provisions of IT Rules thereby leading to Twitter losing immunity conferred under Section 79(1) of IT Act, 2000,” the affidavit mentioned.
Meanwhile, two days back, Twitter said the platform is in its final stages of appointing an executive for the role.
The social media giant said that the interim Resident Grievance Officer of the microblogging site withdrew his candidature on 21 June and it is in the final stages of appointing a new person for the post of Resident Grievance Officer.
In an earlier hearing on May 31, the Delhi High Court had issued notices to both Twitter and the Centre to file their responses while maintaining that the micro-blogging site had to comply with the new IT Rules.
