USCIS STEM OPT: Indian students studying in America have received positive news! The US Citizenship and Immigration Service (USCIS) has updated its rules, particularly benefiting those pursuing STEM subjects—Science, Technology, Engineering, and Mathematics.
Before, foreign students could only work in the US for a year following their graduation. But under the Optional Practical Training (OPT) program, students majoring in STEM subjects now have the option to stay and work for an extra two years, for a total of three years. For students hoping to obtain more job experience in their industry, this extension offers a big boost.
Key Highlights of the New USCIS Rules for Indian Students
Online Classes Now Count Towards F1 Visa Requirements
F1 visa holders are now permitted to take up to three credits or one online course every semester under the revised regulations. This guarantees that distance or online learning is accepted, enabling students to complete their coursework without going against the rules of their visa.
Eligibility for Post-Completion OPT
The updated rules also make it clear that foreign students who earn an associate’s, bachelor’s, master’s, or doctorate degree are qualified for post-completion OPT. In case you are not aware, an associate degree is a two-year course of study that acts as a transitional path from high school to a bachelor’s degree.
School Transfers and Stream Changes Made Easier
The updated rules allow F1 visa holders to transfer from one SEVP-certified school to another. This flexibility also extends to students who wish to change their course stream, whether at the bachelor’s or master’s level.
60-Day Grace Period After OPT
Upon completing the OPT program, students will have a 60-day grace period. During this time, they can either change their education level, transfer to another SEVP-certified institution, or apply to USCIS for a change in their immigration status.
Pathway to H-1B Visa Sponsorship
While OPT can help students gain valuable work experience, their employers may also sponsor them for an H-1B visa. However, this process is subject to a lottery system, and it is not guaranteed that every student will receive a work visa through this route.
Deadline for STEM OPT Extensions
Students seeking a STEM OPT extension must submit Form I-765 (Application for Employment Authorization) no later than 90 days before their current Employment Authorization Document (EAD) expires. This ensures timely processing and prevents work interruptions.
Study Abroad Flexibility
According to USCIS clarification, students engaged in study abroad programs and enrolled in schools with SEVP certification can continue to be active users of the Student and Exchange Visitor Information System (SEVIS). If their course lasts for fewer than five months, this is applicable. Students need to get a new Form I-20 (Certificate of Eligibility for Non-Immigrant Student Status) if the course lasts longer than five months.
