Bombay HC quashes criminal proceedings against Salman Khan in 2019 case

In a sigh of relief for actor Salman Khan, Bombay High Curt has quashed all the criminals proceedings against the actor in a complaint of intimidation filed by a journalist in 2019. The court said that “the judicial proceedings need not be the means of all needless harassment merely because the accused is a celebrity”. The Bombay HC added that “without adhering to the procedure of law, he shall not be subjected to unnecessary oppression at the hands of a complainant, who set in the machinery into motion to satisfy his vendetta and assumed that he was insulted by the cine star.”

Judge Bharati Dangre dismissed the proceedings and process given to Salman Khan and his bodyguard Nawaz Shaikh by a lower court and approved the pleas submitted by them on March 30. 

It was in 2-19 when a journalist reported intimidation in 2019 on behalf of the unexplained. The HC pointed out that the magistrate’s court had broken the procedural rule before issuing the summons in the detailed order that was made accessible on Tuesday.

“The judicial process need not be a means for needless harassment merely because the accused is a well-known celebrity and without adhering to the procedure of law, he shall not be subjected to unnecessary oppression at the hands of a complainant, who set the machinery into motion to satisfy his vendetta and assumed that he was insulted by the cine star,” the order said.

The magistrate should have first recorded the statement of the complainant to verify his allegations, the high court said.

Noting the procedural lapses, Justice Dangre said that they cannot be sustained. “Hence, the order of the magistrate suffers from serious infraction of procedure to be adopted by a magistrate, upon a complaint being filed before him,” the court said.

Salman Khan had approached the court in April 2022. The summon was stayed by the high court on April 5, 2022, after the actor filed a petition in the court. The summons was subsequently contested in a petition that was also filed by Khan’s bodyguard and delayed by the high court.

The complainant had claimed that Salman Khan and Shaikh had verbally and physically attacked and assaulted him when he filmed the actor while he was cycling. Before the magistrate, he had made a private complaint and asked for the actor to be punished.

Salman Khan is currently preparing for the release of his upcoming film Kisi Ka Bhai Kisi Ki Jaan. The film, also starring Pooja Hegde, Shehnaaz Gill, Raghav Juyal and Siddharth Nigam among others, will release on April 21.
