Tunisha Sharma death case: Tunisha Sharma committed suicide in the makeup room of her co-star Sheezan Khan during the filming of their show Alibaba: Dastaan-E-Kabul. This incident shocked fans, friends, and the whole entertainment industry. Tunisha’s ex-boyfriend, Sheezan Khan, was detained shortly after the late actress’ mother, Vanita Sharma, filed a complaint against him, and an abetment to suicide case was filed. On December 25, Sheezan was arrested by Waliv police under Section 306 of the IPC.
Recently, it has been revealed that Tunisha’s maid Reshma had provided her statement in the case. Meanwhile, Supreme Court advocate Khushbu Jain stated her opinion on whether Sheezan Khan may be charged with ‘abetment to suicide.’
Tunisha’s maid Reshma gave her statement
There is a new development regarding Tunisha’s maid. Reshma has provided the police her statement. She has spent a long time working for Tunisha and her mother. Reshma was planned to travel to Chandigarh at night on the same day Tunisha committed suicide, according to reports. The latter, too, had taken time off for the trip. Reshma stated in her statement, ‘Sheezan used to stay with them for 4 to 5 days and had promised the actress’ mother that he would marry Tunisha. However, after their breakup, Tunisha got quite depressed and used to suffer from depression.’
Khushbu Jain explains ‘abetment of suicide’
Khusbhu Jain, a Supreme Court lawyer, has defined what ‘abetment to suicide’ is and whether Sheezan may be held accountable. “The topic of what causes a suicide has no direct solutions because suicidal ideation and behaviour in humans are intricate and diverse,” she explained. Different individuals react and behave differently in the same situation because of the personal meaning they attribute to each experience, accounting for individual vulnerability to suicide.”
“The matter in question revolves on abetment to suicide by Sheezan Khan,” she goes on to add. Suicide abettment is defined as (1) abetting, (2) instigating, or (3) helping the victim in committing suicide. Only until all of these elements of suicide abetment are met may the prosecution build a case of suicide abetment under Section 306 of the Indian Penal Code, 1860.”
“The word “instigate” totally means to goad, urge forward, provoke, incite or encourage to do an offence. A person is said to instigate another person when he openly suggests or encourages him to an act by any means or language, direct or indirect, whether it takes the form of express invitation or of hints, insinuation or encouragement. Instigation can take the form of (explicit) words or (implied) behavior. The phrase “urge onward” indicates to suggest or try hard to persuade someone to do something, to encourage a person move faster in a specific direction, especially by pushing or pressuring such a person. A person instigating another must therefore “goad” or “push ahead” the latter with the goal to provoke, excite, or encourage the latter to execute an act,” she noted.
