Amit Malviya, the head of the National Information and Technology Department of the Bharatiya Janata Party (BJP), sought a “unconditional apology” from Santanu Sinha, an RSS member, over a remark that was deemed “extremely offensive” on Facebook. Via his lawyer, Malviya formally notified Sinha, requesting that he remove the “false and derogatory” post and apologize unconditionally.
Legal Notice Sent to Santanu Sinha
In the legal notice, Malviya’s advocate emphasized the severity of the allegations, stating that they falsely accuse Malviya of sexual misconduct, thereby causing significant harm to his reputation. “The nature of allegations are extremely offensive in as much as they falsely allege sexual misconduct purportedly committed by my client. The same is fatally injurious to the dignity and reputation of my client, who, by virtue of his professional profile, is a public figure. Such malevolently malicious statements have been deliberately made to tarnish his reputation,” the notice read.
Accusations of Malicious Intent
Malviya’s notification also charged Sinha of wrongdoing and having hidden agendas to harm his reputation. The time for the RSS member to withdraw the defamatory message and offer a public apology is three days. Legal action, including criminal and civil defamation cases, will follow noncompliance.
Demand for Civil Damages
The legal notice demands that Sinha pay INR 10 crore in civil damages for the mental harassment, agony, and loss of reputation caused by his Facebook post dated June 7, 2024. “I, the undersigned, therefore call upon you to issue a public apology and take down/remove your defamatory statement(s) given against my client across all public platforms within three (3) days of receipt of this legal notice, failing which my client will be constrained to take appropriate legal action against you Including prosecuting you for civil and criminal defamation at your risk and cost. Further, I call upon you to pay a sum of INR 10 crore as civil damages for the mental harassment, agony and loss of reputation caused to my client that has been caused to my client via your Facebook post dated June 7, 2024,” the notice read.
Congress Calls for Malviya’s Removal
The Congress party demanded that Amit Malviya be removed from his post immediately in response to the allegations. Congress leader Supriya Shrinate demanded an impartial investigation during a news conference, adding that it would only be feasible if Malviya was removed from his powerful position. She underlined the necessity for impartial inquiry into the grave allegations of sexual exploitation as well as justice.
