Article 370 Verdict: The Supreme Court on Monday affirmed the constitutionality of Article 370 in a majority decision, finding that the President’s directive to remove Jammu and Kashmir’s special status was lawful. The court noted that Article 370 was a provision that would expire.
Supreme Court Decrees Swift Return of J&K Statehood
The Supreme Court ruled on Monday that statehood should be restored as soon as possible and that elections in Jammu and Kashmir should take place by September 2024. The five-judge Constitution Bench of the Supreme Court rendered a decision on the legality of Article 370 and upheld the President’s 2019 decree eliminating Jammu and Kashmir’s special status.
Article 370 Designated as Provisional, Not Permanent
On Monday, the Supreme Court declared that Article 370, which gave Jammu and Kashmir special status, is only a provision for the time being. It was decided that even after the Jammu and Kashmir Constituent Assembly was dissolved, the President could still declare that Article 370 was no longer in effect.
