Bilkis Bano case: SC issues notice to Gujarat govt on plea against remission of 11 convicts

Bilkis Bano case: Issuing notice to the Gujarat government, the Supreme Court on Thursday sought its response over pleas challenging remission granted to 11 convicts in the Bilkis Bano gangrape case.

The Supreme Court was hearing three petitions challenging the release of 11 life convicts in the 2002 Gujarat riots Bilkis Bano gangrape case. The matter will be taken up for hearing again after two weeks.

Hearing the plea, Jutsice Rastogi said: “Whatever acts were committed, they were convicted. The question is whether, under the relevant scheme, they were justified in being considered for remission.”

He added that the top court had asked only to consider the matter in accordance with the law. The court also directed all the convicts whose release is being challenged, made a party.

CJI Ramana said, “I read somewhere that Supreme Court has granted permission for remission. No, court said only to consider,” Live Law reported.

A Mumbai court had in July 2008 sentenced 11 convicts to life in prison for raping Bano and killing seven of her family members, including her three-year-old daughter. Bano was five months pregnant at that time.

The order was upheld by the Bombay High Court as well. In 2019, the Supreme Court ordered a compensation of Rs 50 lakh for Bano along with a job and a house.
