The Delhi High Court has permanently restrained the sale of the popular product being sold under Rooh Afza trademark by all the sellers. The court has given this decision on the petition of Hamdard National Foundation. In fact, Hamdard National Foundation had appealed to the court that Rooh Afza made in Pakistan, equivalent to its product, is being sold in India through an e-commerce platform. Rooh Afza is also known as Sharbat in India.
A single bench of Justice Pratibha Singh made the observation in a trademark infringement suit filed by petitioners Hamdard National Foundation and Hamdard Laboratories India (Hamdard Dawakhana), the makers of Rooh Afza in India, claimed that Golden Leaf is selling the product on the e-commerce platform Amazon India under the name of their product – Rooh Afza made in Pakistan. While he did not give the right to Golden Leaf to sell the product in the name of Rooh Afza.
These rules were ignored
Hamdard National Foundation had said in its claim that many things have been violated in the manufacturing of Rooh Afza made in Pakistan. The Legal Metrology Act, 2009, the Legal Metrology – Packaged Commodities- Rules 2011, and the Food Safety and Standards Act, 2006 were used in making Pakistani Rooh Afza. Whereas in preparing this type of product, special care is taken of the rules related to it.

Rooh Afza, popularly known as Sharbat in India, was first prepared by Hakim Hafiz Abdul Majeed in Delhi. After the partition of India-Pakistan, the elder son of Abdul Majeed stayed in India and the younger son went to Pakistan. Although Rooh Afza is owned by the Hamdard National Foundation in India. Whereas Rooh Afza is manufactured by Hamdard Laboratories (Waqf) in Pakistan.
