Former Chief Justice UU Lalit has openly supported the Supreme Court collegium system. Recently, Union Law Minister Kiren Rijiju had called the collegium system opaque and even ridiculed it.
In an interview given to NDTV on Sunday, former Chief Justice Lalit described the collegium system as the most correct and balanced way of appointing judges to the Supreme Court. He said that calling the system opaque is his (Union Minister Rijiju’s) personal view… But it is a perfectly correct and balanced way of doing things. Everyone’s views are respected in the collegium.
The Supreme Court had expressed its displeasure and issued a notice two days ago for not approving the names sent by the Colligeum to the Central Government. Now two days later, former Chief Justice UU Lalit has commented.
The Supreme Court, while issuing the notice to the government, said that it had earlier clarified that once the government has conveyed its objection and it has been disposed of by the collegium, why is the government not approving the appointments of judges.
Continuing attacks on the Collegium
The Supreme Court collegium system has been under constant attack in the last five years. Collegium is the system where the names of judges are decided and sent to the government and the government approves them. Sometimes the government objects to some names in them, sometimes changes them. But now it is being seen that the government sits by stopping the names sent from the collegium system. At present, Law Minister Kiren Rijiju is continuously speaking against the collegium system regarding judicial appointments.
He said on 17 October 2022
- Judges spend half their time deciding who to appoint as a judge instead of delivering justice…. The collegium system is “opaque”…. This happens only in India. It is where judges appoint judges.
The ongoing dispute over the Supreme Court Coliseum will go further. The Supreme Court is about to hear in the last week of this month. If the government confirms the names of the judges sent by the Collegium, then the controversy will stop, but if the government stops the names again, then the Supreme Court can take strict steps.
