Gujarat High Court: The Gujarat High Court bench of justice Nirzar Desai upholds court’s decision denying bail to Teesta Setalvad and has ordered her surrender without delay. The Mumbai based activist was granted interim bail by Supreme Court in September last year which released her from judicial custody. Setalvad is facing charges of fabricating evidence in post-2002 Godhra riots alleged by her.
Charges on Setalvad
Setalvad faces charges of attempting to cultivate a large conspiracy behind the 2002 Gujarat riots. Allegations on Setalvad also pertains to frame Prime Minister Modi and other in the establishment. The state prosecution emphasised during her bail hearing that the charges on Setalvad concerns the alleged fabrication of false evidence. The prosecution claimes that she received an amount of Rs. 30 lakh from late Congress leader Ahmed Patel with motive of destabilizing BJP led Gujarat government in aftermath of 2002 riots.
Last year, An FIR (First Information Report) report was filed by the Ahmedabad Detection of Crime Branch regarding alleged conspiracy of framing innocent people for events of 2002 riots. In June 2022, Setalvad was arrested with co-accused former IPS R B Sreekumar by the Gujarat Police. As per a SIT finding Setalvad received financial aid from a leader of a rival political party to destabilize Gujarat Government with two police officers, Sreekumar and Sanjiv Bhatt.
Court orders Teesta Setalvad to surrender
Last July, government had opposed her bail plea in a sessions court pointing to findings of the SIT. Teesta eventually received interim bail from SC in September. According to testimony of Rais Khan, Setalvad’s former close aide Setalvad met with Congress leader Ahmed Patel at the circuit house in Ahmedabad. In the meeting, Patel allegedly directed Teesta to ensure that certain individuals should be sent behind bars.
Teetsa Setalvad has to been ordered surrender immediately by Gujarat High Court as her interim bail will not be expanded further.
