The Gujarat High Court has dismissed Congress leader Rahul Gandhi’s review petition in the Modi surname case. Justice Hemant Prachhak of the Gujarat High Court while giving the verdict said that the petitioners are seeking relief on a non-existent basis. According to Live Law, Justice Hemant Prachhak said, “there is no rule to stay the decision of the lower court.” This comes under the category of exceptions. It should be resorted to in rare cases. There are 10 cases pending against Rahul Gandhi.
According to Live Law, the Gujarat High Court said during the hearing that there is a need for purity in politics. Justice Hemant said, “A complaint against Rahul Gandhi has also been lodged in the Pune court on behalf of Veer Savarkar’s grandson. In which Rahul Gandhi has been accused of insulting Veer Savarkar at Cambridge University. Not staying the sentence would not be injustice to the petitioner. No reasonable ground has been given for staying the sentence. The award of conviction of the lower court has been just, fair and legal.”
Rahul Gandhi will go to the Supreme Court against the decision
According to the Times of India report, the judge of the Gujarat High Court, referring to the comment case on Veer Savarkar, said that purity in politics is the need of the hour. A public representative should be a person of clean character. Justice said that Veer Savarkar’s grandson has also got a case registered against Rahul Gandhi. Rahul Gandhi can move the Supreme Court against this decision after the Gujarat High Court upheld the sentence received from the lower court.
According to the information received from Congress sources, the party has said to go to the Supreme Court soon in this matter. Congress leader Randeep Surjewala termed the Gujarat High Court’s decision as ridiculous. In a tweet, he said, “Instead of punishing bank fraudsters like Nirav Modi, Ami Modi, Neeshal Modi, Mehul Choksi, the messenger who exposed them is being punished.” He wrote that Rahul Gandhi has chosen the path of truth, righteousness, fearlessness and demanding accountability from those sitting in the bastions of power. Whatever comes in the way, we will remain on the path of truth. Satyameva Jayate.”
