Manish Sisodia: Court reserves order on CBI seeking Delhi Dy CM’s custody

Manish Sisodia: The Rouse Avenue Court on Monday reserved the order after hearing arguments from the CBI and Manish Sisodia’s counsel in a case pertaining to the central probe agency seeking custody of the Delhi Dy CM for five-day. 

“The grounds given in the arrest memo or the remand application can’t be the ground for police remand,” Dayan Krishnan appearing for Manish Sisodia argued. 

Can’t give my phone for second-hand use”

“CBI is showing call logs, but show us any phone calls to me, they are alleging that I destroyed my phone. I’m a minister. I can’t give my phone for second-hand use. It will have confidential data and it can’t be ground,” Krishnan appearing for Sisodia said.

“He was summoned thrice and he appeared twice. CBI alleges that I was concealing true facts of the case. Their case is that I did not confess. That’s their case. They expect me to answer the way they want,” he added.

“Custody Can’t Be Granted As I Didn’t Self Incriminate”

“There can’t be self incrimination, custody cannot be granted because I did not self incriminates. Someone not answering a question cannot be ground for custody,” the Delhi DY CM’s lawyer argued.

“As far as cooperation goes, I appeared when I was summoned. Searches were conducted,” Krishnan said.

“Where is the case that I didn’t cooperate? Just because I didn’t answer the way they wanted? he added.

“Lt Governor gave a nod for the policy in May last year. The CBI is trying to hide the suggestions Lt Governor gave and even those were accepted before implementation,” Sisodia’s lawyer said.

“As per Article 293 A, the government can’t do anything. Everything has to be done with the permission of the Lt Governor. Even the 12% margin clause was part of the note that was sent to the Lt Governor and it was cleared without any objection. The agency wants to go behind what an elected government ought to do,” Sisodia’s lawyer said.
