New Criminal Law: The three new criminal laws recently passed during the winter session of the Indian Parliament are scheduled to be implemented from July 1, according to a government notification.
- Definition of Terrorism Introduced:
- Terrorism is officially defined for the first time in the Bharatiya Nyaya Sanhita.
- The act categorizes a terrorist as someone committing offenses within India or abroad with the intent to threaten the nation’s unity, integrity, and security.
- Punishments for terrorist acts include death penalty or life imprisonment without parole.
- The definition encompasses various activities, including property damage and currency smuggling.
- Sedition Repealed and Replaced:
- The Bharatiya Nyaya Sanhita replaces the sedition provisions of the Indian Penal Code, 1860.
- Section 152 of the new law replaces sedition laws and addresses acts threatening the unity and integrity of the nation.
- Crimes Against Women and Children:
- A new chapter titled ‘Crimes against Women and Children’ is introduced to address sexual offenses.
- Modifications are recommended for provisions related to the rape of women under the age of 18.
- The law aligns with the Protection of Children from Sexual Offences Act (POCSO) regarding gang rape of a minor woman.
- Life imprisonment or the death sentence is prescribed for cases involving the rape of women under 18.
These legislative changes signify a comprehensive approach to tackling terrorism, revising sedition laws, and addressing crimes against women and children in India.
