A Delhi court on Wednesday issued summons to BBC, Wikimedia and Internet Archive on a criminal complaint filed by a BJP leader. The BJP leader has requested them to stop telecasting a documentary on the 2002 Gujarat riots or publishing any other material defaming the Rashtriya Swayamsevak Sangh (RSS) and the Vishwa Hindu Parishad (VHP).
The complainant said that the controversial BBC documentary has defamed organizations like BJP, RSS and VHP. The court was told that the documentary has been banned by the government, however, a Wikipedia page dedicated to the series provides links to view it and the material is still available on the Internet Archive.
Significantly, the Wikimedia Foundation funds Wikipedia, while the Internet Archive is a US-based ‘digital library’. Additional District Judge (ADJ) Ruchika Singla said, “Let trial summons be issued to the respondents (BBC, Wikimedia and Internet Archive) to settle the issues.”
The court listed the matter for further hearing on May 11
Complainant Vinay Kumar Singh said that he is a member of the BJP’s Jharkhand unit’s executive committee and an active volunteer of the RSS and the VHP. It has been said in the petition that the Sangh and the Vishwa Hindu Parishad (VHP) have been defamed through the documentary.
