The National Commission for Protection of Child Rights (NCPCR) claimed in its submission to the Supreme Court that while the concept of gender may be “fluid,” motherhood and motherhood are not. The Supreme Court is now hearing petitions seeking legal recognition for same-sex marriages. The NCPCR informed a five-judge Constitutional bench presided over by Chief Justice DY Chandrachud that it has been maintained in numerous judgements that adopting a child is not a fundamental right, highlighting the legal position in various legislation that the welfare of a child is essential.
