On Tuesday, the Supreme Court (SC) sought a response from the National Investigation Agency (NIA) and the state of Maharashtra in response to the request for house arrest in the Elgar-Parishad case made by incarcerated activist Gautam Navlakha.
The activist, who is 70 years old, filed an appeal with the Supreme Court against the Bombay High Court’s decision on April 26 to deny his request for house arrest due to concerns about inadequate medical care and other basic amenities in the Taloja jail outside of Mumbai, where he is currently being held.
A bench of Justices K M Joseph and Hrishikesh Roy heard the plea and sent notices to the NIA and the state asking for responses.
The subject has been set for a rescheduled hearing on September 29 by the bench.

The case concerns allegedly inciting remarks made at the Elgar Parishad gathering in Pune on December 31, 2017, which the police claim led to violence the following day near the Koregaon-Bhima war memorial on the outskirts of the western Maharashtra city. The conference, according to the Pune police, was planned by individuals with Maoist ties. Later, the investigation was taken over by the NIA.
The petitioner sought the high court based on the top court’s May last year order made in response to a request by the imprisoned activist, according to Navlakha’s attorney during the hearing before the supreme court.
The Supreme Court’s order from the previous year expressed concern about jail congestion and stated that it would be open to the courts to order house arrest for suspects by the Criminal Procedure Code.
