Bengal teacher recruitment case: The Supreme Court stayed Calcutta High Court Judge Justice Abhijit Gangopadhyay’s direction to SC Secretary-General to provide transcripts of his interview by midnight. In a rare 8 pm hearing on April 28, the SC held a special sitting to examine the order passed by Justice Abhijit Gangopadhyay of Calcutta High Court against the Secretary General of the apex court.
Justice Gangopadhyay had directed Supreme Court Secretary-General in the evening to place his interview transcript before him by midnight. The top court’s bench of Justices A S Bopanna and Hima Kohli stayed Justice Abhijit Gangopadhyay’s direction to SC Secretary General and noted that the order by High Court was improper and against judicial discipline. The bench directed the Secretary General to convey the SC’s order to Justice Gangopadhyay.
Flurry of activity
There was a flurry of activity at the high court and the apex court on Friday as the case went back and forth between the two sides.
But what led to the day’s events? Let’s take a look:
April 13: The Calcutta High Court directs the CBI and the ED to interrogate Abhishek Banerjee and Kuntal Ghosh in connection with the Bengal teacher recruitment scam and file a report based on their questioning.
The court also directs the police not to lodge any FIRs or complaints against officers of the two probe agencies who are investigating the alleged recruitment scam, without its permission.
Abhishek Banerjee complains of being pressured
The directions came after Abhishek Banerjee on March 29 said Ghosh was being pressured by the central probe agencies to name him in the case. On March 31, Kuntal Ghosh filed a complaint saying he was being pressured by investigators to name Banerjee.
The court said it should be probed whether “Kuntal took the cue” from Abhishek Banerjee’s speech.
April 17: The Supreme Court stays the Calcutta HC’s order that asked the CBI and ED to probe Abhishek Banerjee. It also listed Banerjee’s plea against the probe for urgent listing on April 24.
April 24: The Supreme Court asks the Registrar General of the Calcutta HC to verify and file a report on whether Justice Gangopadhyay gave an interview to a news channel about the pending case relating to the teachers’ recruitment scam.
April 28: After the Registrar General file his report, the SC directs Justice Gangopadhyay to reassign the case to another judge.
CJI DY Chandrachud, while passing the order, said the bench had “perused the transcript of the interview” and its decision was based on the said transcript.
