Maharashtra political crisis: The Supreme Court will deliver its crucial verdict on May 11 on the pleas by Eknath Shinde and Udhhav Thackrey factions of the Shiv Sena pertaining to the Maharashtra political crisis of 2022.
A Constitution bench headed by the Chief Justice of India (CJI), DY Chandrachud, will pronounce its verdict in the case today. The political crisis in Maharashtra last year led to the fall of the three-partu MVA government ;ed by Uddhav after a revolt by Shinde.
Raised several constitutional questions
On August 23, 2022, a three-judge bench of the top court headed by then chief justice N V Ramana had formulated several questions of law and referred to the five-judge bench petitions filed by the two Sena factions which raised several constitutional questions related to defection, merger and disqualification.
The judgment is expected to answer legal questions such as the validity of the governor’s decision to ask former chief minister Uddhav Thackeray to face a floor test and should the governor have asked the rebel faction leader Eknath Shinde to take oath as chief minister.
The court will also decide whether a notice for the removal of a Speaker restricts him from continuing with disqualification proceedings under the Tenth Schedule of the Constitution, as held by this Court in Nebam Rebia (supra)?
In a blow to the Thackeray faction, the Election Commission earlier this year declared the Shinde faction as the real Shiv Sena and allotted it the bow and arrow symbol of the party founded by Balasaheb Thackeray.
Opposition MVA leaders are hopeful
Meanwhile Opposition MVA learders are hopeful that the verdict will determine if democracy “exists” in the country and judiciary “functions” independently.
On the other side, Shiv Sena spokesperson and party MLA Sanjay Shirsat asserted that there is no nervousness in their camp as they had factored in all aspects before revolting (last year).
“We have seen the results the Election Commission gave us the party name and symbol and we won the first stage,” Shirsat said.
