The Supreme Court will hear Bilkis Bano’s petition on December 13. Bilkis Bano has challenged in the Supreme Court the acquittal of 11 accused convicted in the gangrape case by the Gujarat government. These 11 convicts serving life imprisonment were released on August 15 this year.
A bench headed by Justice Ajay Rastogi will hear the matter. Petitions were already filed in the Supreme Court against the release of the convicts.
‘Good Conduct’ Argument
The ‘good conduct’ of the 11 convicts released in the Bilkis Bano gangrape case was cited by the Gujarat government as the reason behind their release. The affidavit given by the Gujarat government before the Supreme Court revealed that the convicts were out of jail for more days than they were granted parole or furlough.
Out of the 11 convicts, 10 were out of jail for more than 1000 days before being released while the 11th convict was out for 998 days. All of them were out of jail in the name of parole, furlough or temporary bail.
The Gujarat government’s affidavit reveals that a case of outraging modesty was filed against one of the convicts, Mitesh Chimanlal Bhatt, when he was on parole in June 2020, and the investigation in the matter is still pending. The SSP of Dahod had also informed the district court about this.
The 11 people who were released by the Gujarat government are Jaswant Nai, Govind Nai, Shailesh Bhatt, Radheshyam Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Moradhia, Bakabhai Vohania, Rajubhai Soni, Mitesh Bhatt and Ramesh Chandna.
There was fierce opposition to the Gujarat government’s decision to release the convicts. In this case, more than 6000 people had written a letter to the Supreme Court saying that the release of the convicts of Bilkis Bano should be cancelled.
Bilkis Bano was gang-raped by a mob on March 3, 2002. This incident of rape took place in Limkheda taluka of Dahod district. Bilkis Bano was pregnant at that time. Bilkis was 21 years old at that time.
