The Supreme Court on Wednesday rejected Bilkis Bano’s plea to constitute a fresh bench to hear the plea challenging the Gujarat government’s remission of sentence to 11 convicts in her gang rape case.
What did the CJI say regarding the hearing on the matter?
Advocate Shobha Gupta, appearing for Bano, requested a bench of Chief Justice DY Chandrachud and Justice PS Narasimha that another bench needs to be constituted to hear the matter. The CJI said, “The writ petition will be listed. Please don’t mention the same thing again and again.”
Supreme Court Justice Bela M. Trivedi recused herself from hearing the petition filed by Bano on Tuesday. The Gujarat government had pardoned all the 11 convicts in the case and released them on August 15 this year.
Know Case In Detail
She was gang-raped and seven members of her family were murdered during the riots that followed the Bano to Godhra train burning. Bano was 21 years old at the time of the incident and was five months pregnant. The investigation of the case was handed over to the CBI and the trial was transferred by the Supreme Court to a court in Maharashtra. On January 21, 2008, a special CBI court in Mumbai sentenced 11 convicts to life imprisonment.
Later, the Bombay High Court and the Supreme Court also upheld his sentence. The 11 people convicted in the case were released from the Godhra sub-jail on 15 August. The Gujarat government had allowed the release of these convicts under the amnesty policy of the state.
