The Supreme Court of India has rejected a plea for a stay on the Allahabad High Court’s order permitting a scientific survey of the Shah Idgah Mosque complex in Mathura, a significant development in the Krishna Janmabhoomi land dispute. The court has scheduled the challenge to the transfer order for January 9, 2024, according to Vishnu Shankar Jain, the lawyer representing the Hindu side.
Supreme Court Rejects Oral Plea by Muslim Committee
Despite an oral plea by the Muslim Committee, the Supreme Court refused to stay the order passed by the Allahabad High Court, which allowed an application for the appointment of a court commissioner to conduct an inspection of the Shah Idgah Mosque. The court set a date for January 9 to address the challenge to the transfer order, emphasizing that the High Court’s order would continue without interruption.
Hindu Outfits’ Claim and High Court’s Approval for Survey
The dispute centers around Hindu outfits’ claims that the mosque was constructed on the birthplace of Lord Krishna. Hindu groups had long demanded a survey, a request granted by a local court in December the previous year. The Muslim side, however, filed an objection in the High Court.
On Thursday, the Allahabad High Court granted approval for a scientific survey on the Shahi Idgah complex in Mathura. The court appointed an advocate commissioner and tentatively approved the survey, with details about the commission of advocates to be decided on December 18. The survey is expected to follow a similar methodology as the one conducted at the Gyanvapi Temple in Varanasi.
Multiple Cases and Historical Context
The Krishna Janmabhoomi and Shahi Idgah Masjid dispute in Mathura has seen the filing of nine cases so far. Among them is a suit filed by Ranjana Agnihotri, a Lucknow resident, seeking ownership of 13.37 acres of land owned by Shri Krishna Janmabhoomi. Agnihotri’s legal suit specifically calls for the removal of the Shahi Idgah mosque, alleged to have been built in 1669-70 on the orders of Mughal Emperor Aurangzeb within the premises of Katra Keshav Dev temple, near the birthplace of Lord Krishna. The legal intricacies surrounding this dispute continue to unfold as the legal proceedings progress.
