The Supreme Court of India is asking the government to consider creating a national policy on period leaves for female employees. A panel of judges, led by Chief Justice DY Chandrachud, decided this after a recent hearing.
While the Court thinks menstrual leave is an important issue, they don’t believe it’s a matter for the courts to decide. The judges are concerned that a mandatory leave policy might discourage businesses from hiring women.
SC Wants Government to Discuss Polwadicy with Stakeholders
The Court has requested the Ministry of Women and Child Development to talk to various groups about this. This would include companies, women’s organisations, and other relevant parties. These discussions would help decide if a national policy on period leave is a good idea.
The Court has also made it clear that states are free to make their own rules on period leaves. They don’t have to wait for the central government’s decision.
Previous Petitions and Company Practices
This isn’t the first time period leave has been brought up in court. Earlier this year, the Supreme Court rejected a similar petition. However, some companies in India, like Zomato and Swiggy, already offer period leave to their female staff.
The Debate Around Period Leave
The idea of period leave is controversial. Supporters say it would help women who experience difficult periods to manage their health and work. Opponents argue that it could hurt women’s employment prospects.
The upcoming discussions between the government and stakeholders will likely explore these different viewpoints.
