The Supreme Court has dismissed a review petition filed by Bilkis Bano, challenging the apex court’s May 13 verdict. The petition said that Maharashtra’s policy should be implemented instead of Gujarat’s policy to grant immunity to convicts of gangrape and murders, as the trial of the cases took place in Maharashtra.
A bench of Justice Ajay Rastogi and Justice Vikram Nath dismissed the review petition filed by Bano through advocate Shobha Gupta.
In the review petition, Bano said that instead of Gujarat’s 1992 exemption policy, Maharashtra’s exemption policy should be applied in the present case as the trial took place in Maharashtra.
Court’s decision came on a plea filed by Radheshyam Bhagwandas Shah
The apex court’s decision came on a plea filed by Radheshyam Bhagwandas Shah, one of the convicts, seeking a direction to Gujarat to consider his application for premature release under the 1992 policy Was present at the time of sentencing.
Bano has filed a separate petition against the acquittal of 11 men convicted of gang-raping her in the 2002 Gujarat riots. It states that the acquittal of all the convicts was a blow not only to him, but also to his grown up daughters and to the society.
Bano said that despite being five months pregnant, the accused gang-raped her crossing the limits of violence and cruelty. In such a situation, leaving them is a very disturbing decision.
