As per latest Media Reports, the Supreme Court has dismissed a petition challenging the delimitation of assembly and parliamentary seats in J & K. The decision on delimitation wont have a bearing on a separate batch of matters where abrogation of Article 370 is under challenge before a Constitution bench.
Supreme Court dismisses challenge to delimitation of assembly, parliamentary elections in J & K
Bench comprising of Justices Sanjay Kishan Kaul and AS Oka stated,
“Nothing in this judgment shall be construed as giving imprimatur to the exercise of powers under Article 370.”
“We have given the rider that the issue of Reorganisation Act is pending before this Court and we have not said anything on the merits of the same. Otherwise petition is dismissed.”
Haji Abdul Khan and Dr. Mahammad Ayub Matoo, two Srinagar residents, have petitioned the Supreme Court, challenging the increase in the number of seats from 107 to 114. The petitioners had stated in their appeal that it violated Sections 63 of the Jammu and Kashmir Reorganization Act of 2019 and Articles 81, 82, 170, 330, and 332 of the Indian Constitution.
UT’s new Electoral Map by three member Delimitation Commission
In its response to the Supreme Court in December, the Centre claimed that the delimitation process for the Union Territory of Jammu and Kashmir must not wait until 2026 because the goal was to provide the region with immediate democracy.
The delimitation panel revised the UT’s new electoral map in May of last year by increasing the number of members in the J&K assembly from 83 to 90 and allocating 43 seats to Jammu and 47 to Kashmir.
