Umesh Pal Case: On Tuesday, the Supreme Court rejected Atiq Ahmad’s request for protection while being arrested by the Uttar Pradesh police in connection with the murder of Umesh Pal. Atiq Ahmad is a jailed former MP and suspected gangster.
Ahmad said his life was in danger while in the care of the UP police, therefore a panel of Justices Ajay Rastogi and Bela M Trivedi gave him permission to ask the Allahabad High Court for protection.
The court refused to record the former Samajwadi Party MP’s prosecutor’s vehement demands that his client’s life is in danger because the man is in judicial custody and will be protected by the Uttar Pradesh state apparatus in the event that he is threatened.
“It is not a case where this court is going to interfere. Liberty granted to move appropriate application before the High Court. Whatever is the process prescribed under law will be followed,” the bench said.
“I am not shying away from any custody or police interrogation in the case but what I want is grant me protection as there is serious threat to my life,” Ahmad’s counsel said.
The bench, however, dismissed his plea.
The supreme court was hearing a plea for protection made by Ahmad, who also alleged that he and his family had been wrongfully “roped in” as suspects in the Prayagraj murder case of Umesh Pal.
On February 24, a shooting killed Umesh Pal, a crucial witness in the 2005 murder of former BSP Lawmaker Raju Pal, along with his two security guards.
In his plea, Ahmad, who had previously been detained in Gujarat’s Ahmedabad Central Jail at the order of the Supreme Court, made reference to Yogi Adityanath’s threat to “completely ruin and destroy” him in the assembly. He also asserted that there is a “genuine and perceptible threat” to his and his family members’ lives.
