When lawyers strike, consumers of justice suffer, says CJI DY Chandrachud

CJI DY Chandrachud: Chief Justice of India DY Chandrachud on Saturday appealed to the striking lawyers of Gujarat and Telangana to talk to him and resolve the issue. He said when lawyers strike, ‘consumers of justice suffer’.

The advocates are striking against the Supreme Court Collegium’s recommendation to transfer one judge each from the Gujarat and Telangana high courts to Patna.

Give way to harmony

The CJI, who was speaking at the felicitation function organised by the Bar Council of India (BCI), said that the strike makes “consumers of justice suffer”. “Strike must give way to harmony. Much of what confronts us with regard to our problems can be solved through dialogue… I appeal to the members of the Bar to talk to me… When lawyers strike, consumers of justice suffer, not judges,” Chandrachud said.

“We must learn to trust those in authority who have the best welfare of the institution at heart… Question them, but learn to trust them as well,” he said.

Chandrachud supported the collegium system of judicial appointments. He said it takes administrative decisions keeping in view the “national perspective”.

The CJI quoted Dr BR Ambedkar and said strike was relevant during the colonial era, not now.

Rijiju criticises lawyers

Union Law Minister Kiren Rijiju, who was also present at the event, criticised the protesting lawyers for seeking to meet the CJI over the transfer case.

“It can be an individual issue but if it becomes a recurring instance for every decision by the collegium, which is supported by the government, then where will it lead to? The whole dimension will change,” he said. He added that such frequent confrontations are worrying, and all parties must decide what’s good for the institution.

“When I saw lawyers going for the protest…I heard some information that some lawyers are going for some strike on some issues. And in the days to come, these are some of the things which we may see more frequently. We have to think, and we have to decide whether this will be good for the institution,” Rijiiju added.
