The Patna High Court reprimanded the Bihar Police for allegedly demolishing a woman’s house with a bulldozer. In this case, considering the counter affidavit of the station house officer, the court prima facie found that the house was illegally demolished by the state police without following due process of law. Justice Sandeep Kumar made an oral remark during the hearing, ‘Kya Yahaan Bhi Bulldozer Chalega’? Who is such a powerful man who broke his house with a bulldozer. Who do you (police) represent, the state or a private individual? made a spectacle Will demolish anyone’s house with a bulldozer. The judge also accused the police and administration officials of being in collusion with the land mafia.
Justice Sandeep Kumar’s bench orally said, ‘Power has been given to the police to identify the land dispute and its execution? If you have a problem then go to the police station, give money and get someone’s house demolished, close someone’s civil court.’ The counsel for the aggrieved party informed the court that some land mafia is also involved in the case.
The persons have been included as respondent no. 8 to 12 in the petition. Taking cognizance of this, the bench issued notices to the respondents numbered 8 to 12 and directed them to appear before the court through their lawyers on the next date of hearing on 8 December.
The court stayed the FIR registered against the petitioner
Justice Sandeep Kumar directed the SHO of Agamkuan police station to produce the criminal records of respondent nos. 8 to 12. The petitioner’s counsel informed the court that pressure was created against his client and his family members to vacate the land at the behest of the land mafia and a false case was registered. Since a portion of the land was sold to some people, they tried to encroach. On this, the bench assured that the court is there for the protection of the petitioner and not to harass him. Consequently, the court stayed the FIR lodged against the petitioner and directed the police that no one should be arrested.
Expressing his sentiments in front of the state’s counsel, Justice Sandeep Kumar made a verbal remark, ‘5-5 lakh rupees dilwaayenge hum, ghar tootne ka… personal pocket se. They have become agents, haven’t they? Police and CO together are getting houses demolished by taking bribe. This should be stopped.
The court also directed East Patna Superintendent of Police, Patna City Zonal Officer and Officer-in-Charge of Patna Agamkuan Police Station to appear in court on December 8, 2022 in person. The house of the petitioner Sajoga Devi was demolished with a bulldozer on 15 October on the orders of the police administration.
