Himanta Biswa Sarma: Himanta Biswa Sarma, the chief minister of Assam, announced on Tuesday that his administration would investigate whether the state might outlaw polygamy. This is seen as the BJP-ruled region moving closer to the Uniform Civil Code (UCC). In order to investigate the legal implications, the government has also chosen to form an expert group. The expert committee will look into the legality of the state government’s decision to outlaw polygamy in the state.
Supreme Court announced that a five-judge Constitution bench will be established to hear arguments
In order to reach a well-informed judgement, the committee will carefully examine the provisions of “The Muslim Personal Law (Shariat) Act, 1937” and Article 25 of the Constitution. This comes after the Supreme Court announced that a five-judge Constitution bench will be established to hear arguments over the constitutionality of Muslim polygamy and the practise known as “nikah halala.”
New five-judge bench needed to be formed
A bench made up of Chief Justice DY Chandrachud and Justice PS Narasimha noted the arguments made by attorney Ashwini Upadhyay, who filed one of the PILs on the matter, that a new five-judge bench needed to be formed because Justice Indira Banerjee and Justice Hemant Gupta, two judges on the previous constitution bench, had retired. There are several very significant cases before a five-judge court. We shall unite and keep this issue in mind,” the CJI declared.
