The Bombay High Court made a momentous ruling by granting bail to the child accused in the Pune car accident case, in which two IT workers lost their lives tragically in a Porsche that the kid was accused of driving. The court’s decision highlights the importance of the minor’s ongoing meetings with a psychologist and mandates that he be placed under the care of his paternal aunt.
Legal Scrutiny and Decision
The Juvenile Justice Board’s initial remand orders were criticised by the High Court for being unlawful and lacking in authority. The Juvenile Justice Act requires that the minor’s age—below 18—be properly taken into account, as Justices Bharati Dangre and Manjusha Deshpande emphasised. The court emphasised that adolescents must be treated differently from adults who are in legal trouble, even in cases when the offence is serious.
Judicial Concerns
Following the minor’s release from custody and placement in an observation home without seeking higher court intervention, the court expressed grave concerns with the police’s handling of the matter. This move, following the bail granted by the Juvenile Justice Board, was deemed contradictory to the purpose of bail, as per the court’s observations.
