“Every time I took an oath (as Chief Minister of J&K), I did so simultaneously under two constitutions: the Constitution of India and the Constitution of J&K. For me, it’s more of an emotional problem ” Mufti stated. In August 2019, the Centre withdrew Article 370 of the Indian Constitution, which gave the state of Jammu and Kashmir a special status. Some parties, including Mufti’s PDP (Peoples Democratic Party), contested the decision because it virtually put an end to the autonomy the state had enjoyed since India’s independence from Britain in 1947.

Jammu and Kashmir was granted extensive autonomy under Article 370, including the power to enact laws and manage land ownership. The Indian government now has direct control over the state as a result of its revocation, which has been viewed as violating the rights of the state’s citizens. The Centre made the case that Article 370 needed to be revoked in order to better the economic and social development of Jammu and Kashmir and integrate it with the rest of India. Parties like the PDP and NC, however, charged that the government had disregarded the views of the residents of Jammu and Kashmir and had used the revocation to stifle opposition and strengthen its hold over the area.

Up till the cancellation of Article 370 in 2019 Jammu and Kashmir had its own flag and constitution. The Jammu and Kashmir Constitution laid out the authority of the state government and its relationship to the Indian federal government when it went into effect on January 26, 1957. The people of Jammu and Kashmir were also given unique rights and advantages under the constitution, such as the right to employment, education, and land ownership. The Jammu and Kashmir flag, commonly referred to as the “state flag,” had a chakra in the centre of three equal horizontal bands of dark red, white, and green. The previous CM of J&K was Mehbooba Mufti. Under the J&K flag and the Tricolour, she took her oath.
