The Jammu and Kashmir Reorganisation Act has been revised by the Ministry of Home Affairs (MHA), which is a crucial step towards strengthening the powers of the lieutenant governor (LG). Notified on Saturday, this revision is expected to significantly alter the region’s administrative structure.
Key Changes Introduced by the Amendment
The amended rules fall under Section 55 of the Jammu and Kashmir Reorganization Act, 2019. These changes introduce new sections that bolster the authority of the lieutenant governor, a position currently held by Manoj Sinha since August 2020.
New Procedures for Administrative Actions
The MHA’s notification outlines specific procedures for the posting and transfer of Administrative Secretaries and All India Services officers. These proposals must be routed through the Administrative Secretary of the General Administration Department to the LG via the chief secretary.
Finance Department Concurrence Requirements
Moreover, proposals needing the Finance Department’s approval, especially those over which the LG has discretionary powers, must also be presented to the LG through the chief secretary. This step is essential before any proposal is either approved or rejected.
Detailed Notification Highlights
According to the notification, no proposal involving ‘Police’, ‘Public Order’, ‘All India Service’, and the ‘Anti-Corruption Bureau’ will be concurred with or rejected unless it has been reviewed by the lieutenant governor via the chief secretary. This ensures that the LG has a direct hand in key administrative decisions, thereby streamlining governance in Jammu and Kashmir.
