Modi surname case: No coercive action against Rahul Gandhi, rules Jharkhand High Court

Rahul Gandhi has got relief from the Jharkhand High Court in the case of objectionable remarks regarding Modi surname. The court has stayed any coercive action against them. They will no longer have to appear in the lower court.

A hearing was held on Tuesday in the court of Jharkhand High Court Justice Sanjay Kumar Dwivedi on a petition filed against Congress leader Rahul Gandhi for calling all Modi thieves. After hearing all the parties during the hearing of the case, the court has asked Pradeep Modi, who filed the petition in the lower court, to file a reply. On the demand of Rahul Gandhi’s advocate, the court has given him interim relief. The next hearing of the case will be on August 16.

Next hearing of the case on August 16

Rahul Gandhi’s lawyer Kaushik Sarkhel told that no action will be taken against Rahul Gandhi till August 16 in the Modi surname defamation case. The complainant has been given two weeks time to file its reply. Now the matter will be heard on August 16. After the hearing, the High Court has stayed Rahul Gandhi’s order to appear in the court till the next hearing.

The Ranchi court had ordered Rahul Gandhi to be present in person during the hearing. The Modi surname case is to be heard simultaneously in two states on Tuesday (July 04). Rahul Gandhi was to be produced in the MP-MLA court of Ranchi, while the hearing is also to be held in the Patna High Court.

Significantly, a defamation case was also filed against Rahul Gandhi in the Surat court of Gujarat regarding the same matter, in which he has been convicted. It was only after this punishment that his Parliament membership was canceled from the Wayanad seat of Kerala. Ranchi resident Pradeep Modi has filed a defamation case against Rahul Gandhi for his comment on Modi surname. Under this, hearing is going on in the special court of MP-MLA. Pradeep Modi alleged in his application that on April 23, 2019, during the Lok Sabha elections, when Rahul Gandhi came to Ranchi to address an election rally, he had made comments on people with Modi surname, which hurt the sentiments of the entire society.
