A sessions court in Dindoshi, Mumbai has observed that following a girl and repeatedly saying ‘aaja aaja’ to her , despite her clear indication of disinterest in the man is sexual harassment.

It is a landmark ruling because the court has convicted a 32 year old man , under the provision of the Protection of Children for Sexual Offences Act (POSCO).
Case History
Incident of teasing and harassment of the minor student started in September 2015, when she as a class X student would go to attend her tuition classes and the accused would follow her relentlessly in his cycle. The girl had stated before the sessions court about the incident in which she was going to attend French Tution classes on foot and the accused then in his mid-twenties followed her on his bicycle and uttered aaja aaja repeatedly. These dastardly and shameless utterances from the man continued for a couple of days.
The victim also stated that on the first day, she had taken help from the people on the street , to help her in reaching the tuition center. The accused was also chased by a crowd and he managed to flee on his bicycle. In the meantime girl shared her ordeal with her parents and tuition teacher. However, her nightmare continued for few more days as the accused would aggressively follow her.
Later the girl spotted the accused working as a night watchman at an adjoining building. The girl identified the accused to her mother and she took up the matter with the police and filed a complaint, resulting in arrest of the accused in September 2015. However, the accused was granted bail in March 2016.
The accused pleaded before the judge that he had a wife and a three year old girl and was a poor man and asked him for leniency. However, Additional Sessions judge AZ Khan sentenced him to the period he had already undergone as an under trial between September 2015 , when he was arrested and March 2016 , when he secured bail.
