Mohammed Zubair: On Monday, the Muzaffarnagar police lodged a First Information Report (FIR) against Mohammad Zubair, the co-founder and fact checker of Alt News. He is accused of disclosing the identity of a minor involved in the incident where a seven-year-old Muslim boy was subjected to assault by his classmates under the direction of school teacher Tripta Tyagi. This incident was captured in a video that subsequently gained attention after being shared online.
The complainant, Vishnu Dutt, has accused Zubair of revealing the boy’s identity by sharing a video of the incident on social media. On Friday, a video featuring school teacher Tripta Tyagi became viral, depicting a Muslim student from Class 2 being slapped by fellow classmates due to reportedely not completing his homework. This video resulted in widespread condemnation.
FIR against Mohammed Zubair
Zubair has been charged under section 74 of the Juvenile Justice Act, and the FIR was filed by an individual named Vishnudutt. Section 74 of the Act pertains to the offense of revealing the identity of children committed by any individual. Section 74 of the Juvenile Justice (Care and Protection of Children) Act, 2015, explicitly forbids the disclosure of children’s identities. This prohibition extends to cases involving the disclosure of the identity of a deceased minor. Those found guilty of this offense could face imprisonment for up to six months or a fine amounting to Rs. 2 lakhs.
On Saturday, a case was filed against the teacher under sections 323 (pertaining to punishment for voluntarily causing hurt) and 504 (concerning intentional insult with the intent to provoke breach of peace) of the Indian Penal Code (IPC). The complaint was initiated by the boy’s family.
Teacher justifies her act
In her defense, Tyagi stated that the video had been manipulated to infuse a communal aspect into the incident. She further asserted that the video had been recorded by the student’s uncle.
The teacher acknowledged that it was inappropriate for her to instruct the classmates to slap the student. She explained that she felt compelled to take this action due to her physical disability, which prevented her from standing up and directly addressing the student who had not completed his assignment.
