Punjab News: In a significant development, the Supreme Court on Friday upheld the constitutional validity of the Punjab Legislative Assembly’s June session and directed Governor Banwarilal Purohit to take decisions on four pending Bills. The session had been extended, leading the Governor to term it “patently illegal.”
CJI Chandrachud Asserts Constitutional Validity, Urges Governor to Decide on Pending Legislation
Chief Justice of India DY Chandrachud, leading a three-judge Bench, emphasized the Speaker’s authority within the ambit of the Rules of Procedure and urged the Governor to proceed with decisions on the Sikh Gurdwaras (Amendment) Bill, 2023, Punjab Universities Laws (Amendment) Bill, 2023, Punjab Police (Amendment) Bill, 2023, and Punjab Affiliated Colleges (Security of Service) Amendment Bill, 2023.
Court Clarify To The Governor
The Court clarified that the Governor, a titular head, must act on the advice of the Council of Ministers, except in discretionary matters. While refraining from expressing an opinion on the Governor’s constitutional authority, the Bench stated that he could either grant assent, withhold it, or refer the Bills to the President.
Attorney General KK Venugopal sought clarification that repeatedly adjourning the House sine die to avoid prorogation should not be allowed. The CJI assured consideration of this request in the final order. The decision carries implications for the ongoing power dynamics between the Governor and the Legislative Assembly, emphasizing the principles established in a parliamentary democracy.
