Supreme Court: On Monday, the Supreme Court ruled that state governors should “as soon as possible” either consent to measures or return them. When deciding a petition from the State of Telangana asking for instructions to Governor Tamilisai Soundararajan to give her assent to 10 important measures enacted by the state legislature that were still sitting before her, a bench made up of CJI DY Chandrachud and Justice PS Narasimha made the observation.
Governors Should Clear Bills on the Time
The bench cited proviso 1 of Article 200 of the Constitution and stated that constitutional authorities must keep in mind the essential constitutional intent of the phrase “as soon as possible.” A petition from the state government asking the governor to act on bills that are pending before her was being heard by the court. Senior Attorney Dushyant Dave, speaking on behalf of the Telangana government, claimed that due to the Governors’ long delays in assenting to bills passed by the State Legislature, elected state governments were being left at the Governors’ mercy. He added, “Bills are assented within a day in Madhya Pradesh, Gujarat, etc. However, opposition-ruled states are experiencing this.

Several bills had been referred back for further clarification
The bench was informed by Solicitor General Tushar Mehta during the hearing that no bill was waiting for the Governor’s approval and that several bills had been referred back for further clarification. As stated in Article 200, ‘Approval of bills When a Bill has been approved by a State’s Legislative Assembly or, in the case of a State with a Legislative Council, by both Houses of the State’s Legislature, it must be presented to the Governor, who must then declare whether or not he approves the Bill, withholds his approval, or reserves the Bill for the President’s consideration.’ Ten bills were pending with the governor, the state government informed the court. While three bills were forwarded to the governor for her assent in February, seven bills have been pending since September 2022.
