Supreme Court Rules Against Bihar Govt, Finds Ex-MP Anand Mohan Guilty of Violating Release Terms

G Krishnaiah: On Monday, the Supreme Court ruled against the Bihar government and found the former MP Anand Mohan guilty of violating the terms of his early release from prison. Following a change in Bihar’s prison regulations, Anand Mohan, who was given a life sentence for the murder of IAS officer G Krishnaiah, was allowed to leave Saharsa prison last month.

The top court’s instruction came while it was deliberating a petition filed by Uma Krishnaiah, the widow of the murdered IAS officer, protesting the politician-gangster’s hasty release. Anand Mohan was released when the Nitish Kumar-led Bihar government changed prison regulations, which angered a group of central civil services personnel who said it “tantamounted to denial of justice.” The early release of Anand Mohan had sparked a political brawl, with the opposition parties accusing the restoration of the “jungle-raj” in Bihar. The state government maintains that Mohan was freed from custody in accordance with the established guidelines.

Anand Mohan, a ‘bahubali’ (strongman) from the Kosi region of north Bihar, was found guilty of killing Gopalganj District Magistrate G Krishnaiah on December 5, 1994. A mob believed to have been incited by the gangster-politician assassinated Krishnaiah. He was pulled from his company car and lynched. In connection with the slaying of Krishnaiah, the former MP was incarcerated for life. An official statement indicated that 27 criminals who had served 14 or 20 years in prison had been ordered to be released after the Bihar government modified the provisions of the jail manual. On April 27, Anand Mohan, who had served a 15-year prison sentence, was freed. In 2007, a trial court handed down a death sentence to Anand Mohan. The Patna High Court commuted the punishment to life in jail a year later. He next appealed the decision to the Supreme Court, but no relief was given, and he has been held in Saharsa prison since 2007.
