The Supreme Court will now hear the matter on Friday, postponing the initially scheduled Thursday election of Delhi’s mayor. The decision was issued after the Delhi Lieutenant Governor’s office informed the Supreme Court that the election originally planned for February 16 would actually take place after February 17.

A bench led by Chief Justice DY Chandrachud noted that nominated members are not permitted to vote in elections and adjourned a petition filed by AAP mayoral candidate Shelly Oberoi for an early Mayoral election until February 17.
The bench’s observation supported the claim made by the Aam Aadmi Party
“Nominated members cannot go for election. The constitutional provision is very clear,”
The LG office’s Additional Solicitor General Sanjay Jain announced that the election scheduled for February 16 would be moved to a date after February 17 as the top court panel scheduled the case for hearing on Friday.
On February 8, the Supreme Court requested comments on Ms. Oberoi’s plea from the LG’s office, the Municipal Corporation of Delhi’s (MCD) pro tem presiding officer Satya Sharma, and others.

Three failed attempts to elect Mayor amid proloned tussle between AAP ^ BJP
There have been three failed efforts to elect the mayor during a protracted battle between the Aam Aadmi Party (AAP) and the BJP.
The party of Delhi Chief Minister Arvind Kejriwal had earlier proposed holding the mayor election on February 16, and Delhi Lieutenant Governor VK Saxena had agreed.
The BJP and AAP protested the election of the mayor when the councilors met on January 6 and 24, and February 6 after 10 MCD members chosen by the Lieutenant Governor were permitted to vote.
Nominated members, or aldermen, are prohibited from casting ballots during house meetings, according to the Delhi Municipal Corporation Act.
AAP opposes voting right for the aldermen nominated by LG
The Arvind Kejriwal-led AAP has vehemently resisted giving the Lieutenant Governor, who was appointed by the Centre and is accused of advancing the BJP’s agenda by attempting to obstruct the functioning of the Delhi Government, the ability to choose alderman. The nominated members, according to the party, have a propensity to back the BJP.
With 134 ward victories and the end of the BJP’s 15-year hegemony in the local body, the AAP was declared the clear winner of the MCD elections in December. The Congress won nine seats, and the BJP gained 104 wards to place second.
Five one-year terms are available for the position of mayor of Delhi, with the first year designated for women, the second for the open category, the third for the reserved category, and the final two terms once more available for the open category. As a result, Delhi will have a women mayor this year.
After merging three divisions of the municipal body last year, the city will have a single mayor for the first time in ten years.
