In a vehement response to Maharashtra Speaker Rahul Narwkar’s declaration favoring Chief Minister Eknath Shinde’s faction as the legitimate Shiv Sena, party leader Uddhav Thackeray condemned the decision as an “insult to the Supreme Court and murder of democracy.” Thackeray, addressing reporters after the announcement, announced the Shiv Sena UBT faction’s intention to challenge the verdict in court.
Allegations of Collusion:
Uddhav Thackeray accused Speaker Narwekar of collusion with the Shinde faction, asserting that the appointment was motivated by ulterior motives. He expressed doubts about the process, hinting at a deliberate attempt to undermine democratic principles. Thackeray vowed to explore the possibility of filing a contempt case against the Supreme Court.
Constitutional Basis of the Decision:
Speaker Narwekar based his decision on a 1999 version of the Shiv Sena constitution registered with the Election Commission, declaring Eknath Shinde’s faction as the authentic Shiv Sena. He argued that the 2018 version of the constitution provided by Thackeray was “not on record.” According to Narwekar, this constitution did not empower Uddhav Thackeray to remove Eknath Shinde from the party.
Disqualification Petitions Dismissed:
While delivering the verdict on disqualification petitions pending since June last year, Speaker Narwekar dismissed the petitions from both factions. Uddhav Thackeray questioned the validity of the constitution and wondered why, if deemed invalid, they were not disqualified.
The political turmoil in Maharashtra continues as both factions gear up for legal challenges, setting the stage for further confrontations in the state’s political landscape.
