Haldwani Encroachment Removal: The scheduled removal of the railways from the “encroached” area in Haldwani, Uttarakhand, was postponed by the Supreme Court on Thursday and a practical solution was required. According to the Supreme Court’s ruling, the government must fully rehabilitate the local populace. The Apex Court declared “In the meantime, there shall be a stay of the directions passed in the impugned order, prohibiting any further development or building on the property. the Supreemme Court has also issued a notice to the Uttarakhand Government. Next hearing will take place on 7th February.

Petitioners have lived there for more than 70 years as legal residents
The challenge is being heard by Justices Abhay Oka and Sanjay Kishan Kaul. The petitioners stated in their argument that they are low-income individuals who have lived in Haldwani district’s Mohalla Nai Basti for more than 70 years as legal residents.
As the Haldwani Administration prepares for the eviction drive for the encroachment of railway land in the Banbhoolpura section of the town, in accordance with a Nainital High Court ruling, over 4,000 households dread becoming homeless. The local government, police, and railway department worked together to accomplish the demarcation work and joint survey.

Massive protests against evictions
The locals in the Banbhoolpura region have been protesting the clearance of encroachments, claiming that doing so will make them homeless and jeopardise the future of their school-age children. Residents of the area, who would be represented by Congress senior leader Salman Khurshid, petitioned the Supreme Court to overturn the high court’s decision under the leadership of Congress MLA from Haldwani, Sumit Hridayesh.
According to Bhushan, the case involving the demolition of more than 5,000 homes in Haldwani is comparable to the one that will be heard on Thursday.
According to the judgement of the Uttarakhand high court, against which there were widespread protests in Haldwani, the eviction was set to start on January 10. Political parties like the Congress, Samajwadi Party, and AIMIM supported the protests of the long-time residents of the region.
