Uttarakhand: High Court gives nod to 13-year-old Rape Survivor to Terminate 25-Week Pregnancy

Uttarakhand: A 13-year-old rape victim was granted permission by the Uttarakhand High Court to end her 25-week pregnancy. The decision was made on Wednesday by the Sanjay Mishra bench, a senior judge. The court declared that the abortion will be carried out under the direction of the medical board and gave directions for assembling a group of specialised physicians.

The father of the rape victim had petitioned the high court for instructions to be given to the Doon Hospital and the chief medical officer of Dehradun for the best course of action.

The Victim had given her consent for the treatment

The Uttarakhand High Court permitted the girl to end her 25-week pregnancy on the grounds that she was a minor and an unintended pregnancy might harm her mental development. The court cited decisions by the Delhi High Court and Supreme Court allowing an abortion in such cases as well as the Medical Termination of Pregnancy Act of 1971.
For the purpose of monitoring the situation’s development, the next hearing in the case has been scheduled for December 9.

Medical Termination of Pregnancy Act,1971

A law that was considered revolutionary authorised abortion in India up to 20 weeks of pregnancy under specified circumstances and when done by a licenced doctor in a licenced facility. According to the MTP Act, a pregnancy may be terminated if the mother’s life is in danger or if it would seriously harm her physical or mental health if the pregnancy were to continue. Additionally, there is a significant chance that the child, if born, will have severe physical or mental disabilities; the pregnancy was brought on by rape, which is presumed to be a serious injury to mental health; and the married woman or her husband failed to use contraception, which is also presumed to be a serious injury to mental health.
