The Allahabad High Court has extended the stay on the ASI survey of the disputed Gyanvapi complex in Varanasi. There will be a hearing again in the Allahabad High Court regarding this matter tomorrow at 3:30 pm. This stay will remain in force till the hearing tomorrow. The Allahabad High Court started hearing on Wednesday on the appeal of the Anjuman Intejamia Masjid Committee against the survey in the Gyanvapi Masjid complex located in Varanasi. The mosque committee’s counsel argued that the Varanasi court, while passing the order on July 21, had come to the conclusion that the issue could not be settled in the absence of the survey report, but the court before coming to that conclusion had submitted the evidence placed before it. Contents not discussed. He said that the lower court should have acted on the basis of the evidence first presented, but there is no mention of such evidence in the entire complaint.

During the hearing, the counsel for the Anjuman Intejamia Masjid Committee said that the ASI was not made a party to the suit and was directed to conduct a survey and give expert opinion in the matter.

On this, Vishnu Shankar Jain, the advocate for the Hindu side, argued that there is no need to make experts a party in this case and there is no such law that in the matter in which the expert’s opinion is taken, he should be made a party. Giving the example of handwriting experts, Jain said that they were never made a party in any case, even though the court can seek the opinion of a handwriting expert in any case if needed.

SFA Naqvi, counsel for the Anjuman Intejamia Masjid Committee, said that the plaintiffs actually do not have any evidence and they want to present evidence with the help of the ASI survey. To this, the court asked him that if the law permits such collection of evidence, what would be the harm to the petitioner. Naqvi said that this is not the proper stage for ASI survey in the case before the Varanasi court. Hindu side’s lawyer Vishnu Shankar Jain said that the ASI’s survey is not going to cause any damage to the structure.
